We have a project where we're being asked to close the void at all of the Non-Rated Exterior Wall / Non-Rated Floor Intersections, despite the fact that these floors have been chosen to be open to each other without shaft protection (most of the upper floor level looks down into the floor below). What section of the code would allow the void to remain open?

I am not sure if you are using the IBC Code, but 2018 Version of IBC Code addresses this. This would be Section 715.4.1 (and section 715.5 for the 2021 IBC Code). The code states that "[v]oids created at the intersection of exterior curtain wall assemblies and nonfire-resistance-rated floor or floor/ceiling assemblies shall be sealed with an approved material or system to retard the interior spread of fire and hot gases between stories." This tells us that something--whatever the "approved material" may be--does need to be installed at that joint intersection.
If you want documentation for a non fire-rated solution showing an "approved material," we can address your application through an Engineering Judgment, which will be a custom detail showing your exact application with the firestop components required to maintain the stated ratings.
